1. Agreement to Terms

Welcome to Oazera — Pametno. Sigurno ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at your-domain.com (the "Website") and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes, subject to these Terms.

4.3 Restrictions

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OAZERA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

7.3 Maximum Liability

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim, or 100 EUR if no payments were made.

8. Indemnification

You agree to indemnify, defend, and hold harmless Oazera, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or inability to use the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

9. Termination

9.1 Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Services will immediately cease.

9.2 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature within the Services. Upon termination, we will delete your personal information in accordance with our Privacy Policy.

9.3 Effect of Termination

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Jurisdiction

10.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

10.2 Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Croatia, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute through good faith negotiations for a period of at least thirty (30) days.

11.2 Arbitration

If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration in accordance with the Croatian Arbitration Act. The arbitration shall take place in Croatia, and the language of arbitration shall be Croatian or English as mutually agreed.

11.3 Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class, consolidated, or representative action.

12. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

We comply with the General Data Protection Regulation (GDPR) and Croatian data protection laws in our handling of personal information.

15. Severability and Waiver
